Escape This Booking Terms

Https://escapethis.com.au website is operated by Escape This Pty Ltd (also referred to as ‘us’ & ‘we’ in this document). We invite you to use the website on condition that you, the user (also referred to as ‘you or ‘your’), accept all our terms, conditions, policies and notices stated here as the user and all the persons for whom the booking is made or transferred.


You are automatically bound by and agree to accept the following terms and conditions when you visit this website or use our services by purchasing our products. These Terms of Service apply to all users of our website including but not limited to users who are browsers, vendors, customers, merchants, and/ or contributors of content. We reserve the right to change or replace any aspect or part of these terms by posting updates on this website, which is your responsibility to check before using our service.


1. BOOKING CONDITIONS

The first named person on the booking is considered to be the ‘lead name’ and agrees on behalf of all persons included in the booking that he/she:

  • has read, understood and agreed to our terms and conditions.
  • confirms that he/she and all members of the party are of the appropriate age to purchase the services.
  • understand and accept to our use of information disclosed in our Privacy & Cookies Policy.
  • all information provided is true and correct, to the best of your knowledge and belief.


2. GIFT VOUCHERS

Please note that gift vouchers:

  • are valid for 3 years starting from the date of purchase.
  • cannot be redeemed for cash.

If a booking value exceeds the value of the voucher, additional must be paid by the redeemer.


3. AGE RESTRICTIONS

Players must be the age stated on the game or over at the time of the booking.

  • If the group contains any children under the age of 14 then an adult must remain onsite for the duration of the booking (but does not need to accompany the group into the room).
  • If the whole group is 14 and older no adult needs to remain on site.
  • If you have a child too young to participate we can sometimes arrange for them to accompany the group as a spectator into the room, with the exception of Horror themed rooms.
  • Those under the age of 18 will not be permitted to play our Horror rooms, even if accompanied by an adult.


4. JURISDICTION & APPLICABLE LAW

These Terms & Conditions and any agreement to which they apply are governed in all respects by the laws of Western Australia and each party agrees that any dispute, claim or other matter which arises out of or in connection with your contract or booking will be dealt with by the Courts of Australia only.


5. SPECIAL REQUESTS

All special requests must be notified to us at the time of booking. Although we will do our best to accommodate any special requests, we regret we cannot promise that the requests will be complied with unless a written confirmation has been specifically sent to you. Failure to meet any special request will not be a breach of contract on our part unless the request has been confirmed. We do not accept bookings that are conditional upon any special request being met.


6. DISABILITIES & MEDICAL PROBLEMS

If you or any member of your party has any medical problem or disability which may affect the individual’s ability to take part in our activities, please contact us in writing with full details before you confirm your booking so we can advise you further. We may require you to produce a doctor’s certificate certifying that the person(s) in question is fit to participate in the activity.


If we are unable to accommodate the needs of the person(s) concerned, we will not accept your booking. If you fail to give us full details at the time of booking and the booking is subsequently cancelled, cancellation charges will apply when we become aware of these details. If the booking goes ahead and the person/s cannot take part, an you failed to inform us in writing of the situation, the booking will be cancelled and payment will be forfeit. Verbal advice on this matter is not recognised as valid notification.


7. BOOKING & PAYMENT TERMS

The Lead Name must receive prior consent from all members of the party to book our services and be made aware of these terms and condition to which they are bound.


The Lead Name must be 18 years of age or over at the time of the booking and is responsible for all the following:

  • full payment of booking including any subsequent amendment or cancellation charges that may arise.
  • acceptance and confirmation that all members of the party read and agree to be bound by these terms and conditions.
  • provide all members of the party with full information in relation to the booking, including any consequent changes.


A booking is made when:

  • you accept our quote based on your selected services and/or products and…
  • you check-out and pay the quote and…
  • we issue you with a booking confirmation to the provided email in the booking.


When a booking confirmation is issued, a contract between you and us will exist that will confirm the details of your booking.

If you believe that any of the details provided in the booking confirmation is wrong, it is your responsibility to contact and notify us immediately. Failure to do so, may result in the loss of your rights.


Escape This Pty Ltd., uses a 3rd party payment platform, Stripe to process payments and charges. We do not store or host any debit or credit card information on our website and do not have access to such information.


8. ADMISSION TERMS

We want all of our visitors to enjoy their experience and we would like to remind you that access to our premises are subject to these terms:

  • we require proof of booking before giving you access to the rooms.
  • babies and toddlers are not permitted in our rooms accompanied or otherwise without express advance permission which will normally be withheld.
  • visitors under the age of 14 shall be allowed only if accompanied by at least one adult at all times. In such cases, the Lead Name will be responsible for the welfare of all members of their group who are aged under 14.
  • we reserve the right to refuse admission to, or to require to leave the premises (without providing a refund) anyone:
  • where there might be a risk to your safety or the safety of others if we do not do so.
  • who behaves in an antisocial way and, or appears, to be intoxicated.
  • who is smoking inside the premises.


Please arrive 15 minutes before your scheduled start time. We reserve the right to delay or refuse the admittance of latecomers if the

We shall not be liable for refusal of access of latecomers and no refund will be given however, entirely at our discretion, we may offer to reschedule in specific circumstances.


9. MODIFICATIONS TO THE SERVICE AND PRICES

Changes by us:

  • Prices for our products and services are subject to change without notice.
  • We reserve the right at any time to modify or discontinue the Service (or any part or content) without notice.
  • We will do our best to meet all your requirements that are under our control. However, whenever necessary, we reserve the right to make modifications to and correct errors to the event details before and after your booking has been confirmed.
  • If we need to make major changes or cancel your booking, you will be offered alternative booking arrangements or a full refund of all monies paid.
  • For changes made by us, you must notify us your choice within 7 days of our offer. If you fail to do so we will assume that you have chosen to accept the change or alternative booking arrangements.
  • All changes to your booking made by us will be notified to you as soon as possible.
  • We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
  • In exceptional circumstances, we may be forced by “Force Majeure” to change or terminate your arrangements.
  • The maximum liability to you and your party in any and all circumstances is a full refund. We will not be held responsible for any compensation or meet any costs or expenses you incur as a result of any changes or cancellation made by us.


Changes by you:

  • Any changes made to the booking after it has been made must be sent to us in writing as soon as possible.
  • Amendments must be requested from the email used to make the booking.
  • We shall do our best to meet your requirements but cannot guarantee that all requests will be met.
  • If you wish to re-schedule your time slot, you must notify us in writing at least 2 days (48 hours) before the date of your booked game. We will rearrange your booking wherever possible but cannot guarantee it. An admin fee of $25 will be applicable per change.
  • No refund or rescheduling is available for requests made within 48 hours of your booking or for no-shows. These are both treated as cancellations.
  • Where your rescheduling request cannot be met, and you do not wish to proceed with the original booking, we will treat this as a cancellation by you.
  • The addition of players is not considered a chargeable change and will be accommodated if there is space.
  • Once bookings are paid in full, if you want to reduce your group numbers, a credit voucher will be issued for any difference in price.
  • Individual rooms cancelled from multi-room bookings, also incur a $98 cancellation fee if they are removed within 7 days of the event. If you arrive at the venue and then decide your group will all go in one room, we will charge a cancellation fee of $98 for the unused room and the group number will be adjusted for the room you use.


The following cancellation charges apply to all bookings:

  1. Less than 7 days: $98 per room booked and booking fee.*
  2. Between 7 and 21 days: $49 per room booked and booking fee.*
  3. Greater than 21 days: $25 per room booked and booking fee.*

*An additional $49 per room cancellation fee applies to all multi-room synchronised start time bookings to cover additional costs and losses associated with these types of bookings.


10. OUR LIABILITY TO YOU

Please note, we cannot accept any liability and will not be responsible or pay you any compensation for any damage, injury, illness, death, loss, cost, expense or any other sum or claim of any type which results from any of the following:

  • the act(s) and/or omissions(s) of you and/or another member of your party OR…
  • the act(s) and/or omission(s) of a third party not connected with the provision of the services contracted for and which were unforeseeable or unavoidable OR…
  • unusual and unforeseeable circumstances beyond our or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised (including, without limitation, the circumstances outlined in the section entitled “Force Majeure” below) OR…
  • an event which we or the supplier of services, even with all due care, could not foresee or forestall.


We are not responsible for any accidents which:

  • occur in ‘Escape This’ buildings due to your inappropriate or irresponsible behaviour.
  • any accidents which occur anywhere on our property because of any items or property which you have broken and/or have left in a way in which injury can result.


For the avoidance of doubt, nothing in this agreement shall limit or exclude our liability for death or personal injury resulting from our negligence, for fraud or fraudulent misrepresentation or for any other liability the exclusion or limitation of which is not permitted by Australian law.


11. YOUR RESPONSIBILITIES AND LIABILITIES

In addition to our admission terms, we would like to remind you that you are responsible for:

  • your safety, actions and the effect they may have on others.
  • the condition of the property you occupy and the damage you may cause to them.
  • your own timekeeping. If you arrive after your scheduled booking time, we reserve the right to cancel your booking without providing any refund.


12. FORCE MAJEURE

Except where otherwise specified in these terms and conditions, we will not accept liability or pay any compensation where the performance of our contractual obligations is affected by reason of circumstances amounting to “Force Majeure”. In these terms and conditions “Force Majeure” means any event which we or the supplier of the services in question could not, even with all due care, foresee or avoid. Such events including and not be limited to war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather condition, fire and similar impediments which are beyond our reasonable control may constitute Force Majeure.
